Declaration of the 2nd Meeting of the Committee on Clinical Application of Human Organ Transplantation of China and National Summit of Clinical Application and Management of Human Organ Transplantation

We, medical practitioners of human organ transplantation, met in the 2nd Meeting of the People’s Republic of China Ministry of Health Committee on Clinical Application of Human Organ Transplantation and National Summit of Clinical Application and Management of Human Organ Transplantation in Guangzhou, Guangdong Province, People’s Republic of China, on 13 and 14 November 2006.

We have studied “The Resolution on Major Issues Regarding the Building of a Harmonious Socialist Society” of the 6th Plenum of the 16th Central Committee of the Communist Party of China, and will implement the requirements of “strict regulation and assessment of medical institutions and medical practitioners for organ transplantation”.

With reference to the guiding principles on human organ transplantation established by the World Health Organization, we have carried out extensive research and held discussions on the subject according to the current situations in the country, and reached a consensus.

We aim to promote human organ transplantation in China and ensure that it is healthily, systematically and legally developed; protect the rights of the donors of human organs and the patients; ensure the health and safety of the people; and implement harmonious development of the society.

We hereby declare that:

1. Medical practitioners in China will adhere to the regulations that govern permission to perform human organ transplantation in medical institution and develop human organ transplantation according to the rules and plans of the Ministry of Health Committee on Clinical Application of Human Organ Transplantation under the leadership of the health administration at different levels (country, province, and city).

2. Medical practitioners in China will strictly follow the medical and ethical rules in developing human organ transplantation, comply with the professional ethics of medical practitioners, respect human lives, and attain health of the people.

3. China medical practitioners who are involved in human organ transplantation guarantee that they will not take part in any human organ transactions and any related activities, and that they will not take part in any trans-border human organ transplantation in the name of travel and any related activities. Transactions of human organs are strictly prohibited, as well as trans-border performance of organ transplantation in the name of travel.

4. People of China, including those in Hong Kong, Macau and Taiwan, are given the first priority in receiving human organ transplantation services in China. Under special circumstances, people of other countries may receive organs after specific application procedures.

5. Written consent must be obtained from a human organ donor before organ removal and the removal must be done according to the procedures prescribed by law. When the donor is unable to give his consent, written consent must be obtained from his family.

6. A living-related organ donor must be a person who has reached the age of 18 with complete civil behavior and abilities. A recipient of a live organ is restricted to one who is the spouse, lineal relative by blood of, and collateral relative by blood up to the third degree of kinship of the live organ donor.

Medical practitioners in China will adhere strictly to the above six rules in the development of human organ transplantation.


2006年11月13—14日,中国卫生部人体器官移植技术临床应用委员会第二次 会议扩大会议暨全国人体器官移植技术临床应用管理峰会在广东省广州市召开。与会的人体器官移植领域医务工作者认真学习了十六届六中全会《中共中央关于构建 社会主义和谐社会若干重大问题的决定》,认真落实“严格医疗机构、技术准入和人员执业资格审核”的要求,参照世界卫生组织人体器官移植指导原则,结合中国 国情,进行了深入研究、讨论,达成共识。为了推进中国人体器官移植事业健康、有序、规范发展,维护人体器官捐献者和广大患者的合法权益,保障公民健康和生 命安全,实现社会和谐发展,特作如下声明:

一、中国医务工作者将在各级卫生行政部门(国家、省、市)的领导下,根据卫生部人体器官移植技术临床应用委员会的统一部署,严格遵守人体器官移植技术医疗机构和医务人员准入有关规定,遵循人体器官移植技术规范开展人体器官移植工作。

二、中国医务工作者将严格遵守医学准则和伦理原则开展人体器官移植工作,恪守医务人员职业道德,尊重人的生命尊严,促进人民群众健康。

三、从事人体器官移植的中国医务工作者承诺不参与任何人体器官买卖及与之相关活动,不参与任何以旅游名义跨国境实施的人体器官移植及与之相关活动。严禁人体器官买卖,严禁以旅游名义跨国境实施人体器官移植。

四、中国人体器官移植应当优先满足本国公民(包括香港、澳门、台湾)人体器官移植需要。特殊情况下,对于其他国家和地区公民提出的人体器官移植申请,履行特定程序后实施。

五、摘取人体器官必须取得捐献者本人书面同意,并按照法律规定的程序实施。当捐献者本人不能作出同意表示时,必须取得其亲属的书面同意。

六、活体器官捐献者必须是年满18周岁、具有完全民事行为能力的公民;活体器官接受者与活体器官捐献者之间仅限于夫妻关系、直系血亲和三代以内旁系血亲。

中国医务工作者将严格遵守以上六点准则开展人体器官移植工作。

中国人民解放军和中国人民武装警察部队医疗机构和医务人员支持和响应此声明。
