Notice Regarding Further Strengthening the Administration of Radio and Television Channels (Chinese and English Text)
On August 4, 2005 the State Administration of Radio, Film, and Television promulgated the "SARFT Notice Regarding Further Strengthening the Administration of Radio and Television Channels" to the radio and television offices (bureaus) of the provinces, autonomous regions, and independent municipalities. The "Notice" pointed out that recently, some radio and television stations have been leasing and conveying radio and television channels, frequencies and time slots, and programs (hereinafter referred to as "Channels") in a disguised form, and this has lead to a weakening of propaganda editorial power and economic control authority, and influenced the propaganda security and ongoing order of radio and television. . . .
1. In accordance with the "Regulations on the Administration of Radio and Television" (State Council Order Number 228), "Certain Decisions Regarding the Entry of Non-Public Capital into Cultural Industries" (National Issue [2005] Number 10), and other related laws and regulations, radio stations and television stations may not lease or convey broadcast time. Non-public capital, foreign capital, and foreign-backed capital may not be invested in the operations of radio or television stations through any means, and may not become involved in radio or television stations or propaganda editorial duties.
2. Based on the premise of keeping a firm hold on the power to appoint leading cadres, the power to make policy regarding important matters, the power to control the disposition of assets, and the power to make final decisions regarding the contents of propaganda, radio stations and television stations may establish separate company operations for music, technology, athletic, and entertainment program production duties and advertising representation operation duties, capital expenditures for which shall be made in cash, and may not establish a company through the use of channel resources, professional work, or brands as capital expenditure or under cooperative conditions. With the permission of SARFT, based on the premise that the radio station or television station controls at least 51% of shares, the aforementioned program production companies and advertising representation operation companies may accept non-public investment purchase of shares, but the investing party may not participate in editorial operations.
3. Radio stations and television stations must maintain complete control over their channels' location, program set up, organizational arrangement, screening of broadcasts and other propaganda editorial powers, as well as advertising pricing, time arrangement, screening of dissemination and other operational policy decision making powers. On the basis of grasping the initiative in program planning (including type, style, and content) and production duties, radio stations and television stations may use such methods as coordination and commissioning to cooperate with social organizations to produce radio and television programs, provided they are not political news or similar types of special feature or series. . . .
5. Strengthening the administration of radio and television channels is a matter that concerns the Party's control over the core media resources and the security of our country's ideology, with strong political character and adherence to policy, we must not only place a high degree of emphasis on this, and we must have a determined attitude, and be conscientious about reliability and particular as to methods. Radio and television administration agencies, radio stations, and television stations must further strengthen their political consciousness, general situation consciousness, responsibility consciousness, battlefield consciousness, and treat this work as a serious political duty, and grasp it as firmly as possible. . . .
广电总局关于进一步加强广播电视频道管理的通知
2005年8月4日,国家广电总局向各省、自治区、直辖市广播影视局(厅)发出《广电总局关于进一步加强广播电视频道管理的通知》,《通知》指 出,近一个时期以来,一些广播电台、电视台出现了变相出租、转让广播电视频道、频率和时段、栏目(以下统称频道)的现象,导致了宣传编辑权和经营控制力的 削弱,影响了广播电视宣传安全和运行秩序。为了适应形势发展要求,进一步加强广播电视频道管理,切实保障广播电视健康有序发展,通知如下:
一、根据《广播电视管理条例》(国务院令第228号)、《关于非公有资本进入文化产业的若干决定》(国发〔2005〕10号)等相关法规的规 定,广播电台、电视台不得出租、转让播出时段,非公有资本、外资及外资背景资本不得以任何方式投资经营广播电视频道,不得通过经营活动变相进入广播电视频 道及宣传编辑业务。
二、在牢牢掌握主要领导干部任免权、重大事项决策权、资产配置控制权、宣传内容终审权的前提下,广播电台、电视台可将音乐、科技、体育、娱乐等 节目制作业务、广告代理经营业务剥离组建公司运作。广播电台、电视台组建节目制作、广告代理经营公司,应以现金出资,不得将频道资源、业务、品牌等作为出 资或合作条件组建公司。经广电总局批准,在广播电台、电视台控股51%以上的前提下,上述节目制作公司、广告代理经营公司可以吸收非公有资本投资参股,但 投资方不得参与宣传编辑业务。
三、广播电台、电视台必须要完全掌控频道定位、栏目设置、组织编排、审查播出等宣传编辑权和广告定价、时段安排、审查发布等经营决策权。在掌握 节目策划(包括类型、风格、内容)和制作业务主导权的基础上,广播电台、电视台可以联合、委托等方式与社会机构合作制作时政新闻及同类专题、专栏以外的广 播电视节目。广播电视广告代理企业可以对具体广告的播出时段安排提出建议,但不得同时向播出机构提供与所代理经营的广告时段相关的广播电视节目,不得以任 何方式参与、影响广播电视宣传编辑业务。
四、各级广播电视部门要按照本通知要求做好检查规范工作。对参与频道合作经营的非公有资本、外资及外资背景资本,要中止合同,妥善处理善后工 作;对违规经营和通过节目、广告代理经营等方式变相进入宣传编辑业务领域的,要整改规范;尚未签订合同协议的,要一律停止。10月15日前,各级广播电 台、电视台按本通知要求进行自查自纠,省级广电行政部门负责检查验收,不符合要求的要督促完成整改。对未能按期完成自查自纠和整改规范工作的广播电台、电 视台,要按照中宣部、广电总局《关于建立违纪违规广播电视播出机构警告制度的意见》给予警告处分;情节严重且不按要求整改的,将按照《广播电视管理条例》 规定给予撤销频道的处罚。
五、加强对广播电视频道的管理,事关党对媒体核心资源的控制,事关我国意识形态的安全,政治性、政策性很强,既要高度重视,态度坚决,又要细致 稳妥,讲究方法。各级广电行政部门、广播电台、电视台要进一步增强政治意识、大局意识、责任意识、阵地意识,把这项工作作为一项严肃的政治任务,切实抓紧 抓好。10月底前,各省级广电行政部门将检查纠正情况报广电总局,广电总局将在全国范围内进行检查。
