Publication Marketplace Special Agent System for the Heilongjiang Sweep Away Pornography and Strike Down Illegal Publications Task Force (Chinese and English Text)
In order to strengthen the day-to-day supervision and administration of publication marketplaces, safeguard the regular order of the publication market, and promote a prosperous market, it has been decided to implement a special agent system for all publication marketplaces in the province.
1. The Substance of Special Agents' Work and Professional Responsibilities
Special Agents shall be executive personnel of the press and publication and cultural executive administration departments dispatched to publication marketplaces, and their professional responsibilities shall include:
(1) being responsible for propagandizing and implementing the relevant laws, regulations, and general and specific policies of the Communist Party and government regarding the publications market;
(2) being responsible for the supervision and administration of the day-to-day business activities of operators in markets;
(3) being responsible for the organization and administration of the work of submission and screening of publications prior to their sale;
(4) being responsible for coordinating the work of submitting, screening, and identifying suspected illegal publications in markets;
(5) accepting complaint reports in markets, and reporting them to the executive administration departments in a timely manner;
(6) having a grasp of the situation in publishing markets, and report it to the executive administration departments in a timely manner.

(2) Special Agents may not independently exercise executive sanction powers, and with respect to business activities in markets that violate discipline or the law, shall carry out warnings, stopping, or timely reporting to the responsible departments, and shall actively cooperate with executive law enforcement work.

黑龙江省出版物集中经营场所特派员制度
黑龙江省“扫黄打非”办公室
为加强对出版物集中经营场所的日常监管，维护出版物市场正常秩序，促进市场繁荣，决定在全省出版物集中经营场所实行特派员制度。
一、特派员的职责及工作内容
特派员是各级新闻出版、文化行政管理部门派驻出版物集中经营场所的行政管理人员，其职责为：
1、负责党和国家关于出版物市场有关法律、法规和方针政策的宣传、实施；
2、负责对市场内业户日常经营活动的监管；
3、负责出版物售前送审工作的组织管理 ；
4、负责对市场内涉嫌非法出版物的送审与鉴定的协调工作；
5、受理场内举报，并及时向行政管理部门汇报；
6、掌握出版物市场动态，及时向行政管理部门报告。
二、特派员的选派及标准
特派员由各地出版物市场行政管理部门具有执法资格的管理人员或市场稽查人员兼任。各地可根据本辖区出版物市场集中经营场所的实际情况进行选派。具体标准是：
1、具有较高的政治觉悟和政策水平；
2、熟悉出版物市场管理有关法律、法规和政策；
3、工作认真负责，为人正派，办事公道，清正廉洁；
4、具有一定的组织协调和独立处理问题的能力。
三、特派员的纪律
1、依法行政，文明执法；
2、发现问题，处理及时，并准确向行政管理部门汇报，不得缓报、漏报、隐瞒不报；
3、廉洁自律，不接受馈赠，不吃拿卡要。
四、特派员与其他行政执法人员的关系
1、特派员是出版物市场行政管理部门常驻出版物集中经营场所的行政执法人员。
2、特派员不得单独行使行政处罚权，对市场内的违纪违规经营活动，应当进行警告，制止或及时向主管部门汇报，积极配合行政执法工作。
五、特派员的管理与奖惩
1、实行定期述职报告制：特派员应每月向行政管理部门就所驻市场的工作情况定期述职；
2、实行定期轮换制：特派员每三个月轮换一次；
3、实行责任追究制：特派员对市场内发现的问题缓报、瞒报、知情不报或不处理、处理不当的，要追究其行政责任；
4、实行奖惩制：行政管理部门要定期征求经营业者对特派员的意见，特派员对所驻市场发生的违纪违规问题，处理及时得当，派出行政管理部门给予表彰奖 励；特派员出现不廉洁、不文明等行为，或对所驻市场发生的违纪违规问题，处理不当或隐瞒不报，可视情节，取消其特派员资格或给予行政处分。
