Shijiazhuang Intermediate People's Court Judgment in the Cai Lujun Incitement to Subvert State Power Case (CECC Partial Translation and Chinese text)
Defendant Cai Lujun, previously used the name "Hoping for Democracy" and "Struggling for Democracy," Male, Born August 16, 1968, ID number: 130105680816121, Han ethnicity, high school education level, native of Feixiang county, Hebei province, prior to arrest made a living by trading stocks and doing business, resided at Room 102, Unit 5, Building 16, West Sanzhuang Residential Area, Shijiazhuang city. Placed under residential surveillance on February 22, 2003 by the Shijiazhuang Municipal State Security Bureau, placed under criminal detention on March 3, and arrested on suspicion of inciting subversion of state power on April 8. Currently detained at the Shijiazhuang Number 1 Detention Center. Defense counsel Wang Jiguang, Hebei Zhufeng Law Firm. Defense counsel Wang Huimin, who is the mother of defendant Cai Lujun, retired from the Hebei Trade Building. In the case of defendant Cai Lujun inciting subversion of state power, the Shijiazhuang Municipal People's Procuratorate initiated a prosecution with this court on June 28, 2003 pursuant to the Shijiazhuang Criminal Indictment (2003) Number 102. After this court accepted the case it constituted a collegial panel in accordance with the law, and tried this case in closed court. The Shijiazhuang Municipal People's Procuratorate appointed procurator Yuan Sheqiang to appear in support of the prosecution, and defendant Cai Lujun and his defense counsel Wang Jiguang and Wang Huimin appeared in court to participate in the litigation. Trial proceedings have now concluded. The Shijiazhuang Municipal People's Procuratorate charged: 1. On May 17, 2002 defendant Cai Lujun used an IBM computer at his residence at Room 102, Unit 5, Building 16, West Sanzhuang Residential Area, Shijiazhuang city to dial into the Internet (dialing telephone number 7793891), and using the name "Hoping for Democracy," announced the establishment of the "China Freedom and Democracy Alliance" on the Web site across the strait in a section belonging to the straits ruling party. Cai admitted Luo Changfu of Chongqing (Intern name 1234, 123), Yuan Liangsheng of Hunan (Internet name China's Ignorant Masses), Wen Fangqiang of Jiangxi (Internet name Dragon in the Sky), Liu Yi of Hubei (Internet name Happy Revolutionary) and many other members in Hong Kong, Taiwan, and Germany to particpate in the organization, and became its first chairman. Cai defined a party platform for the organization: return the power of government to the people to stop corruption, return the military to the country to terminate absolute power, return commerce to the market to increase the people's wealth, and return the facts to history to warn the future. During the initial stage the basic program would be: oppose despotic and autocratic systems, support a democratic and unified China, support democracy within and insist on patriotism without. Under Cai's organizational strategy elections produced a chairman, a vice chairman, a standing committee, and an inspection committee, and the members planned and formulated constitutional documents, a meeting banner, and an emblem. This organization's meeting activities were carried out in online discussion rooms, communications were carried through electronic mail boxes, Web site chats or ICQ, BADDY TALK, etc. . . . This court finds that defendant Cai Lujun established the "China Freedom and Democracy Alliance" on the Across the Straits Web site, and using this organization as intermediary, distributed to or discussed with other members on the Internet articles and speech aimed at attacking the socialist system and harming national security. He also distributed articles that he had written and were aimed at viciously slandering and starting rumors regarding the leadership of the Communist Party, inciting subversion of state power, and overthrowing the socialist system. This behavior constitutes the crime of inciting subversion of state power. Defendant argues that the articles he distributed, downloaded, copied or disseminated are protected by the Chinese Constitution's guarantee of freedom of speech and for this reason his conduct is not a crime. This court finds that defendant Cai Lujun's conduct clearly was incitement, satisfying the requirements of the crime. His behavior is qualitatively different with that of going through ordinary channels to provide government organs with reasonable suggestions or reform measures. For that reason, defendant Cai Lujun's proferred defense rationale cannot stand.

This court finds that defendant Cai Lujun established the "China Freedom and Democracy Alliance" on the Across the Straits Web site, and using this organization as intermediary, distributed to or discussed with other members on the Internet articles and speech aimed at attacking the socialist system and harming national security. He also distributed articles that he had written and were aimed at viciously slandering and starting rumors regarding the leadership of the Communist Party, inciting subversion of state power, and overthrowing the socialist system. 被告人蔡陆军，曾用名“盼民主”、“争民主”，男，1968年8月16日出生，身份证号：130105680816121，汉族，高中文化，河 北省肥乡县人，被捕前以炒股、做生意为生，住石家庄市西三庄生活小区16栋5单元102室。2003年2月22日被石家庄市国家安全局监视居住，3月3日 被刑事拘留，同年4月8日因涉嫌煽动颠覆国家政权罪被逮捕，现押于石家庄市第一看守所。

被告人蔡陆军煽动颠覆国家政权一案，由石家庄市人民检察院于2003年6月28日以石检公刑诉（2003）第102号起诉书，向本院提起公诉。 我院受理后，依法组成合议庭，不公开开庭审理了本案。石家庄市人民检察院指派检察员谢强出庭支持公诉，被告人蔡陆军及其辩护人王继光、王惠民到庭参加诉 讼，本案现已审理终结。
石家庄市人民检察院指控：
1、2002年5月17日，被告人蔡陆军在石家庄市西三庄小区16栋5单元102室自己的家中利用IBM电脑，使用电话（号码7793891） 上网，在互联网海峡对岸网站的海峡政党栏目，以“盼民主"的名义，宣布成立“中国自由民主同盟会"，蔡吸纳了重庆的罗长福（网名1234、123）、湖南 的袁浪生（网名中国愚民）、江西的温方强（网名龙在天）、湖北的刘颐（网名快乐的革命者）等包括香港、台湾、德国多名成员参加该组织，并自任第一届主席。 蔡为该组织确定了党纲：还政于民以杜贪官，还兵于国以绝强权，还商于市以增民富，还实于史以诫万年。现阶段最低纲领：反对独裁专制制度，支持民主统一中 国，对内支持民主主义，对外坚持民族主义。在蔡的组织策划下选举产生了主席、副主席、常委、监委，由会员自行设计制定了章程、会旗、会徽。该组织的会议活 动在网上聊天室进行，联系用电子信箱、网站的悄悄话或ICQ、BADDY TALK等。
2、自2000年4月以来，被告人蔡陆军在自己家中利用IBM笔记本电脑上网，在海峡网大陆时事栏目、谈天说地栏目、纵横书海栏目、海峡对岸网 站的大陆政治栏目、南北社区的不寐思想论坛、民主与自由论坛以“盼民主”、“争民主”“蔡陆军”的名义发表自己的原创文章：《建国、治国概要》、《我们立 誓要为推翻共产党的专制统治做点事，倡导民主治国》、《小议中共人大正在酝酿出台的》、《为什么要推翻中共的独裁专制统治》、《是被杀一儆百吓死？还是尊 严的站起来？》、《民主论坛的目的何在？》、《请记住：任何人任何党派无论它多么伟大、光荣、正确，它都有其局限性！答雨柔》、《论当今政治垄断及其危 害》、《答老左：一党及多党的区别》、《给对推动民主治国失望的同志们的劝告》、《民主治国可行》、《能够推翻中共的只有他们自己》、《我对六四的几点看 法》、《中共比我等普通的中国人多长一个脑袋？》、《谈谈中共的独裁之处》等多篇文章，恶毒攻击中国共产党的领导，煽动颠覆国家政权和推翻社会主义制度。
3、自2001年5月以来，被告人蔡陆军以“盼民主"名义利用电子邮件不断向网友发送其搜集的《中国六四真相》、《远华黑暮》、《黄祸》、《人 祸》、《中共太子党》等非法出版物的电子版，并公开声明自己有这些书的电子版，只要需要者留下电子邮箱就立即发送。2002年4月2日，蔡在给网名叫“老 狗”的回帖中称“这段时间以来，我的‘生意’还挺红火，一共发出去超过3000本了，不过，我也并不怕它们，人家发送12本就判了三年，我都成这样了，就 不在乎它们了”。2002年4月30日至5月6日，“盼民主”在自己的家中上网，在海峡对岸大陆政治栏目，分多次将《中国六四真相》公开粘贴。2002年 9月1日，蔡陆军以“盼民主”的名义在海峡对岸大陆政治栏目公开了其保留的多本非法出版物的书名，并宣称，你如需要，我会在24小时内给你发过去。
4、自2000年4月以来，蔡陆军在“因特网”上还公开下载、复制、传播他人的攻击党和社会主义制度的文章，如《张志新的生前死后》、《华人与狗不 得入内》、《万般皆下品唯有做官高》、《矛与盾的思绪》、《中共的财政赤字已经到了足以亡国的程度》、《中国何处去？中美台港经济战略与政策运用之比 较》、《大话西游之两岸风云》、《中国能否提高选举民主化程度》、《武大郎炊饼涨价听证会》、《民主这池清水何以变得如此浑浊》、《今天社会进步是体制外 革命的结果》、《写在“六四”十三周年》、《收买人大常委失败的旁证》、《六四英雄王维林、廖亦武（上）》、《单挑“共产主义”》、《渴望免于恐惧的生活 写在颁行20周年》、《三派相碰胜者谁？--诡秘的中共16大》、《中国的宪法是“死”是“活”》等多篇文章。
被告人蔡陆军对指控的犯罪事实供认不讳，辩解其发表文章、下载、复制、传播他人的文章是我国宪法赋予其的言论自由的权利。其辩护人主要提出，被 告人蔡陆军成立“中国自由民主同盟会”属网络游戏，且该组织无经费，该同盟会的纲领出自民主人士李笠农的文章。其行为不属于造谣、诽谤。仅属方法、方式问 题，故其行为不构成犯罪。
经审理查明：

3、自2000年4月以来，蔡陆军在“因特网”上还公开下载、复制、传播他人的攻击党和社会主义制度的文章，如《张志新的生前死后》、《张志新 的生前死后》、《民主这池清水何以变得如此浑浊》、《收买人大常委失败的旁证》、《三派相碰胜者谁？--诡秘的中共16大》等多篇文章。
以上犯罪事实，关于被告人蔡陆军在互联网“海峡对岸”网站成立“中国自由民主同盟会”的犯罪事实，被告人蔡陆军供认；该同盟会的会员罗长福（网名 “123”、“1234”、“正义与良知”、“毛泽东2”）、袁浪生（网名“中国愚民”）、温芳强（网名“龙在天”）、刘颐（网名“快乐的革命者”、“台 独就是台独”、“蝎子的尾巴”）均证实蔡陆军是该同盟会的发起人，是第一任主席。且罗长福、袁浪生、刘颐还证实，其均看过蔡陆军在网上发的《是被杀一儆百 吓死？还是尊严的站起来？》等文章，或证实蔡陆军向其发送过意在攻击中国共产党的领导、煽动颠覆国家政权和推翻社会主义制度的文章。有石家庄市国家安全局 于2002年5月27曰在互联网上下载的“中国自由民主同盟会”所在的网站的网页，该网页证实“中国自由民主同盟会”的现任主席为“盼民主”，党员人数为 27人等内容。有石家庄市国家安全局于2003年2月下载的“中国自由民主同盟会”的党员名单，该名单证实“盼民主”为该党党员。以上证据证买，被告人蔡 陆军在互联网上成立未经国家机关批准的“中国自由民主同盟会”的非法组织后，以该组织为中介，在互联网上向其他会员发送或与其他会员谈论一些旨在攻击社会 主义制度、危害国家安全的文章或言论。故辩护人所提被告人蔡陆军成立“中国自由民主同盟会”属网络游戏的辩解理由不能成立。以上证据证实对该项的指控成 立。
关于指控的被告人蔡陆军在互联网上发表《建国治国概要》、《我们立誓要为推翻共产党的专制统治做点事，倡导民主治国》、《小议中共人大正在酝酿 出台的》、《为什麽要推翻中共的独裁专制统治》、《是被杀一儆百吓死？还是尊严的站起来》、海峡网纵横书海栏目中对《中国六四真相》一文的回帖、《矛与盾 的思绪（三）学生难道不可以爱国吗？学生不应该爱国吗？》中的回帖等其自己原创的多篇文章的犯罪事实，被告人蔡陆军供认；有石家庄市国家安全局于2002 年9月20日、2003年1月13日、2003年2月17日在互联网上下载的蔡陆军发表在“海峡网”、“海峡对岸”网等网站的文章22篇，该22篇文章中 的《建国治国概要》、《我们立誓要为推翻共产党的专制统治做点事，倡导民主治国》、《小议中共人大正在酝酿出台的》、《为什麽要推翻中共的独裁专制统 治》、《是被杀一儆百吓死？还是尊严的站起来》、海峡网纵横书海栏目中对《中国六四真相》一文的回帖、《矛与盾的思绪（三）学生难道不可以爱国吗？学生不 应该爱国吗？》中的回帖等多篇文章，经本院审查，其意旨在以造谣、诽谤的方式恶毒攻击中国共产党的领导，煽动颠覆国家政权和推翻社会主义制度。以上犯罪事 实还有石家庄市国家安全局提取的被告人蔡陆军用于上网的电脑中所存放的33篇原创文章予以印证。以上证据证实对该项的指控成立。
关于指控的被告人蔡陆军利用电子邮件向网友发送其搜集的《中国六四真相》、《远华黑幕》、《黄祸》、《人祸》、《中共太子党》、《河殇》等书籍 或文章的犯罪事实，河北省新闻出版局证实，以上所列书籍或文章属非法出版物。经本院审查，无证据证实以上非法出版物的内容属于造谣、诽谤或者其他方式煽动 颠覆国家政权和推翻社会主义制度的言论。故以上被告人之行为不构成煽动颠覆国家政权罪，故对该项的指控不能成立。
关于指控被告人蔡陆军在互联网上公开下载、复制、传播他人的攻击中国共产党和社会主义制度的文章的犯罪事实，经本院审查，《张志新的生前死 后》、《民主这池清水何以变得如此浑浊》、《收买人大常委失败的旁证》、《三派相碰胜者谁？--诡秘的中共16大》等文章中，有以造谣、诽谤的方式攻击中 国共产党的领导人或煽动颠覆国家政权的言论。还有石家庄市国家安全局于2002年9月16曰在“海峡网”、“海峡对岸”网上下载的蔡陆军公开下载、复制、 粘贴传播的他人的文章等证据证实。以上证据证实对该项的指控成立。
本院认为，被告人蔡陆军在互联网“海峡对岸”网站成立“中国自由民主同盟会”，以该组织为中介，在互联网上向其他会员发送或与其他会员谈论一些旨在 攻击社会主义制度、危害国家安全的文章或言论，在互联网上发表其自己原创的旨在以造谣、诽谤的方式恶毒攻击中国共产党的领导，煽动颠覆国家政权和推翻社会 主义制度的文章，或在互联网上公开下载、复制、传播他人的攻击中国共产党和社会主义制度的文章，其行为已构成煽动颠覆国家政权罪。被告人蔡陆军辩解，其发 表文章，下载、复制、传播他人的文章是我国宪法赋予其的言论自由的权利，其辩护人亦提出被告人蔡陆军之行为不构成犯罪，本院认为，被告人蔡陆军之行为有明 显的煽动性，符合该罪的构成要件，其行为与通过正常途径向有关国家机关提出合理建议或改良措施的行为有质的区别。故被告人蔡陆军及其辩护人的辩解理由不能 成立。依照《中华人民共和国刑法》第一百零五条第二款、第五十五条、第五十六条之规定，判处如下： 被告人蔡陆军犯煽动颠覆国家政权罪，判处有期徒刑三 年，剥夺政治权利一年（刑期自判决执行之日起计算，判决执行以前先行羁押的，羁押一日折抵刑期一日。即自2003年3月3日起至2006年3月2日止）。
如不服本判决，可在接到判决书的第二日起十日内，通过本院或者直接向河北省高级人民法院提出上诉，书面上诉的，应当提交上诉状正本、副本各一份。
